The Texas County prosecutor is seeking the forfeiture of $1,223 alleged to be used in drug trafficking in Houston, according to a court filing.

Texas County Prosecutor Parke Stevens Jr. filed paperwork seeking the funds that were found as part of drug investigation conducted by the Houston Police Department. James W. Fithen Jr. was searched and the funds found, according to court documents.

The defendant was in possession of the cash monies and were the same bills used in a prior controlled drug buy, according to the court filing. Stevens noted with that evidence, the dollars had been used in prior criminal acts.
