A judge ruled Friday that Texas County commissioners can’t gag a critic who has a lawsuit filed against it.

Judge Ronald White denied a motion to silence George Sholtz, who the commissioners argued was harassing it over the airwaves of Big Country 99.3, the radio station he owns and manages. Separately, the judge ruled Sholtz’ request for production of documents in his case was overbroad and denied a restraining order for the commission to stop involving itself in township matters.

Sholtz sued the commission last November for damages related to a fatal farming accident involving his son-in-law.
