Texas County was dropped this week as a defendant in a wrongful death lawsuit involving an accident in Cass Township.
The Texas County Commission heard Monday, Aug. 6, that litigation against it had been dismissed. The news came from Mark Turley, who represents Tessa Dixon in the lawsuit concerning an accident that claimed the life of her husband, Justin, in July 2018.
Cass Township and Texas County were named as defendants. It was dismissed without prejudice, which means it can be refiled within a year.
“We are pleased to make this announcement, as our position has always been the county is not responsible for road maintenance in any of our 17 townships,” the commission said in a statement. “We wish to thank the firm of Keck and Austin for their diligent work in getting this matter resolved.”
