A Cabool man faces four felony charges after allegedly firing a rifle at another man during an incident Sunday at Mountain Grove.
Brian K. Johnston, 46, of 818 Main St. in Cabool, is charged with armed criminal action, discharging a firearm from a vehicle at a person, second-degree assault and unlawful use of a weapon (while intoxicated).
According to a Texas County Sheriff’s Department deputy’s report, officers were dispatched after a shooting was reported at a Sunshine Drive residence at Mountain Grove.
A Mountain Grove man there told officers he went to his 42-year-old sister’s house and that she and Johnston had been in an argument and she had blood on her. The man said he went back to his Sunshine Drive residence and was working on the roof, and saw Johnston’s truck coming down the road, so he got down from the roof. He said Johnston then pointed a rifle at him through the driver’s side window, so he ducked behind a nearby van and heard three shots before Johnston drove away.
Johnston was located by Cabool police, and during questioning he claimed the other man had pointed a gun at him and fired one shot. But he also reportedly admitted to having gone to the other man’s home and firing a shot into the ground.
During a search of Johnston’s vehicle, a Marlin .22 magnum rifle loaded with seven rounds was reportedly found, along with marijuana and a smoking device. The officer noted in the report that Johnston smelled of alcohol and was visibly drunk.
Johnston is held without bond in the Texas County Jail.
