REMOVAL SOUGHT

Paperwork to oust the Texas County sheriff was signed Friday morning by a circuit judge. 

Circuit Judge John Beger reviewed the matter, appointed a special prosecutor to pursue it and hand-delivered a copy to the acting sheriff, Marie Lasater. 

The special prosecutor, Don Trotter, filed paperwork in Texas County Circuit Court late Thursday afternoon seeking to remove Texas County Sheriff James Sigman from office.

Sigman, who was arrested Wednesday night on six felonies and two misdemeanor charges, is the subject of a  quo warranto that was filed at the Texas County Justice Center. Trotter, who also is the Lawrence County prosecutor, seeks the ouster of Sigman for violating the responsibilities of his office in a six-count petition. 

The sheriff, who is free on bond, has 10 days to respond, if he wishes, and is barred from performing any duties as sheriff. The special prosecutor also asked that upon any final hearing and determination that Sigman be ousted and pay all costs associated with the action. 

The preliminary petition says Sigman neglected his official duties. Trotter says the sheriff:

•Willfully failed to enforce the criminal laws of the state. 

•Willfully failed to suppress an assault.

•Willfully failed to quell assaults.

•Willfully committed the criminal offense of forgery.

The petition mirrors information contained in a grand jury indictment.
