A Texas County governmental entity is accused of wrong-doing in a lawsuit filed in Texas County amid an ongoing squabble there and seeks an injunction to force compliance.
Court documents show that Rocky Dailing, a taxpayer there, filed the suit against William Brown and Virginia Austin, members of the township board. In the suit filed last week, Dailing alleges the pair:
•Failed to get competitive bidding, including advertising, for a bridge construction project. It also did not obtain a permit, according to the suit.
•Don’t maintain accurate and open records under the state’s Sunshine Law.
•Utilized funds in an improper manner by allowing nepotism among its workers.
•Allowed a worker, Jerry Stallcup, to operate a commercial vehicle without proper certification.
•Permitted and caused dumping of waste from the bridge’s construction on Dailing’s property.
Minutes show Stallcup was fired by Brown at a Feb. 10 meeting. It was at that meeting, in a closed session, board president Brown and treasurer Austin submitted a written resignation but it was not accepted because another member wasn’t there.
According to electronic court records, a response has not yet been filed.
