Charges were dismissed last week against a former Piney Township official accused of theft, but the Missouri attorney general’s office said Tuesday the charges will be refiled.

Roger L. Martin of Houston was to have been tried last Thursday and Friday in Texas County Circuit Court before Circuit Judge Bill Hickle. Court documents — before they were closed to the public upon the dismissal — show that the Missouri attorney general’s filed a motion last Wednesday seeking a continuance. The next day the court dropped the charges. The office was handling the prosecution of Martin, who was charged with theft of $26,292 in January 2013. Martin resigned in July 2012.

In a charging document from December 2012, the Missouri State Highway Patrol alleged Martin used a fuel credit card without the knowledge of fellow township members.

Nancy Gonder, the spokesperson for Attorney General Chris Koster, said Tuesday the charges will be refiled. She said she didn’t have information on why they had been dismissed.

Another defendant charged as part of the investigation, Jackie Cooper, entered a guilty plea earlier. A restitution hearing is Oct. 7.
